THE REGISTER (IN BULGARIAN)

Overview:

According to the provision of Art. 3, Para. 1 of the Act on administrative regulation of economic activities, related to crude oil and petroleum products (The Act) any entity which carries out one or more of the economic activities listed in Art. 2, Para. 1, shall be subject to registration under this Act.

The first registration of the entities should take place before starting the activity.

In the event of a change of registered circumstances, within 7 days of its occurrence, the registered entity should submit an application to the Minister of Economy and Industry, along with the documents certifying that change (if any).

Terms of delivering the service:

Within 14 days from the completion of the verification of the application and the documents attached to it.

Step by step procedure:

  1. Application submission

The entities subject to registration/change of registered circumstances shall submit an application form – Appendix 2 of the Ordinance No. RD-04-2 of 16.07.2019 on the terms and conditions for keeping a register of persons carrying out economic activities related to crude oil and petroleum products (the Ordinance) along with all documents needed for the specific activity for which they apply, in any of the following ways:

– In person or by a proxy with a notarized PoA or by a lawyer

– Sent by a licensed postal operator: addressed to the Ministry of Economy and Industry, 1052 Sofia, 8 Slavyanska St

– Sent by email in accordance with the Electronic Government Act to e-docs@mi.government.bg or by using the Secure Electronic Delivery System, provided by the Ministry of e-Government.

When the application and the documents attached to it are to be submitted by electronic means, they shall be signed with a Qualified Electronic Signature (QES) of the applicant or its representative, with the exception of the Declaration under Art. 14, item 3 of the Ordinance, which shall be signed with the personal QES of the declarant.

The entities providing the required collateral for the activities under Art. 2, Para. 1, Item 1, Item 3, Item 5 or Item 6 of the Act in the form of a cash deposit, shall pay it to the following bank account of the Ministry of Economy and Industry:

  1. Verification of the application

Officials from the Administrative Regulation and Control of Economic Activities Directorate verify the submitted application and the documents attached to it. In case that the submitted documents and data are incomplete and/or inaccurate, the applicant will be notified in writing and shall correct any incompleteness or incorrectness within 14 working days.

  1. Entry in the register and issue of a certificate

After conclusion of the verification, officials from the Administrative Regulation and Control of Economic Activities Directorate shall prepare a proposal for entry or refusal of entry in the register. Upon entry in the register, the Minister of Economy and Industry or authorized by him Deputy Minister issues a certificate of registration. If the applicant does not meet one or more conditions for registration the Minister of Economy and Industry or authorized by him Deputy Minister refuses entry in the register by a reasoned order.

  1. Service of the certificate of registration

The certificate of registration shall be delivered in person to the applicant or to their proxy upon signed acknowledgement, or sent by a licensed postal operator with acknowledgement of receipt to the address provided by the applicant. If the certificate is delivered to a proxy, a copy of notarized PoA shall be submitted.
