Administrative Regulation and Control of Economic Activities

“Administrative Regulation and Control of Economic Activities” Directorate main functions and duties:

1. Organises the issuance of licences, registration certificates and import/export permits; maintains registers; and conducts ex-ante and ex-post controls over compliance by licensed and registered entities with their obligations in relation to the following economic activities:
   a) manufacture of optical disks and of stampers for the manufacture thereof;
   b) production of ethyl alcohol of agricultural origin, distillates and spirit drinks, as well as activities involving distillation equipment for the production of ethyl alcohol, distillates and spirit drinks, including through cooperation with “National Institute for Research and Certification” EOOD;
   c) drug precursors;
   d) performs other activities related to licensing and registration regimes as assigned by the Minister;
2. Implements trade policy measures related to the import and export of goods into and from the territory of the Republic of Bulgaria;
3. Maintains the Register of Trade Intentions for the categories of goods specified by law, receives, processes and issues import and export documents in accordance with the applicable legislation;
4. Administers regulatory regimes for the implementation of mandatory non-tariff measures within the European Union relating to quantitative restrictions on trade between the European Union and third countries;
5. Maintains the Public Register of persons engaged in mining, processing and transactions with precious metals and precious stones and products with and from them by occupation;
6. Organises, coordinates and oversees the overall regulatory process concerning the manufacture and trade of tobacco products and related products, including by drafting national legislation regulating activities in the sector; transposes the requirements of European Union law in this field into national legislation; provides opinions on draft European Union legislation; and performs other related functions;
7. Administrative regulation for providing notifications from manufacturers and importers of new tobacco products and smoking products other than tobacco products before they are placed on the Bulgarian market;
8. Administrative regulation for providing notifications from importers and manufacturers of electronic cigarettes and refillable containers before they are placed on the Bulgarian market;
9. Maintains the Public Register of persons intending to carry out the import, introduction into the territory of the Republic of Bulgaria, manufacture, sale, supply or refurbishment/recycling of machinery and/or equipment for the manufacture of tobacco products;
10. Maintains the Public Register of persons holding permits for the manufacture of tobacco products, including permits that have been revoked;
11. Maintains the Public Register of persons carrying out economic activities associated with oil and petroleum products;
12. Ensures the comprehensive administration and implementation of the registration procedures under Chapter Two of the Act on Administrative Regulation of Economic Activities Associated with Oil and Petroleum Products;
13. Participates in the exercise of control under the Act on Administrative Regulation of Economic Activities Associated with Oil and Petroleum Products;
14. Provides organisational and technical support for the work of the Advisory Council for Cooperation between State Authorities and Persons Carrying out Economic Activities Associated with Oil and Petroleum Products, established under the Minister;
15. Provides administrative and technical support for the Minister’s activities under the Act on Administrative Regulation of Economic Activities Associated with Oil and Petroleum Products;
16. Cooperates with the Ministry of Energy, the Ministry of Finance, the Ministry of Agriculture and Food, the Ministry of Environment and Water, the Executive Agency “Automobile Administration” and the Executive Agency “Railway Administration”, the General Directorate “Fire Safety and Civil Protection” of the Ministry of Interior, the General Directorate “Combating Organised Crime” of the Ministry of Interior, the State Agency “State Reserve and Wartime Stocks”, the State Agency for Metrological and Technical Surveillance, the Bulgarian Institute of Metrology, the Customs Agency, the National Revenue Agency, the Commission for Protection of Competition, the State Agency for National Security, and the representative branch organisations of persons carrying out the economic activities referred to in Article 2(1) of the Act on Administrative Regulation of Economic Activities Associated with Oil and Petroleum Products;
17. Participates in the preparation of opinions, positions, analyses and information concerning Bulgaria’s participation in the work of the institutions of the European Union, including in relevant working parties, committees and other working forums, as well as in informal contacts, and provides institutional representation;
18. Drafts reports on the status of regulated activities, formulates proposals for legislative amendments within its functional competence, and conducts impact assessments when required.
19. Supports the Economic Policy Directorate in driving the Better Regulation agenda by drafting specific proposals aimed at regulatory simplification and streamlining administrative requirements for companies
20. Provides comprehensive administrative support to the Minister in implementing the Act on Compensating Consumers for Transport Costs.
21. Participates in drafting the Ministry’s financial forecasts and draft budget, and contributes to the execution of programs within the Ministry’s program-based budget tracks based on its functional competence.
